En septembre 2018, la Cour européenne des droits de l'homme condamne l'Italie pour avoir violé l'article 3 de la Convention qui interdit de soumettre quiconque à des peines ou traitements inhumains ou dégradants, par rapport au régime de détention « dure » appliqué à Bernardo Provenzano, chef historique de la mafia. Le cas a permis de conduire une réflexion plus approfondie sur les caractères de ce régime établi par la loi sur le système pénitentiaire (art. 41- bis O.P.), sur sa compatibilité avec les principes fondamentaux internes et européens (à travers l'étude des positions de la Cour constitutionnelle italienne, de la CEDH et du Comité européen pour la prévention de la torture) et sur les équilibres délicats entre le respect des droits de l'homme et la lutte contre les organisations criminelles.
