RésuméTiraillé entre des objectifs contradictoires, le droit pénal des mineurs a perdu, depuis le début des années 2000, quelque peu de sa cohérence. Le manque d'approche globale du droit pénal dans son ensemble est une des causes de ce phénomène qui conduit à punir plus sévèrement les mineurs que les majeurs. Cette étude plaide en faveur d'une meilleure coordination du droit spécifique avec le droit commun afin de maintenir une égalité des mineurs et des majeurs devant la loi pénale. Si certaines incohérences semblent avoir déjà trouvé une résolution, d'autres sont encore en souffrance.
