Séculaire et mutante, la justice pénale repose sur des fondements et poursuit des fins qui ne cessent d'être interrogés, modifiés et parfois rétablis. Les réformes pénales envisagées par l'actuel garde des Sceaux en attestent. Ces mutations permanentes ont totalement obscurci la rationalité qui anime la justice pénale. Cet article propose d'en éclairer certains rouages et de mettre en lumière le tournant que cette rationalité semble aujourd'hui amorcer.
