L'essor de la logique répressive sécuritaire, qui se traduit par une emprise toujours plus grande et toujours plus inflexible du pouvoir répressif sur le citoyen invite à s'interroger sur l'héritage contemporain de la défense sociale nouvelle et ses appels à la modération et l'humanisation de la répression.Une telle entreprise nous invite à penser la défense sociale nouvelle comme un véritable humanisme pénal, dont il nous faut restituer toutes les dimensions et implications. Un humanisme exigeant, qui s'applique aussi bien à la définition et à la mise en œuvre de la politique criminelle qu'à la théorie et la pratique du droit pénalDe ce point de vue, l'influence de la défense sociale nouvelle sur notre système répressif s'avère contrastée. Certes, l'héritage humaniste de notre modèle pénal est indéniablement mis en cause par la logique répressive sécuritaire. Mais, parce qu'ils ont acquis une force juridique supra-légale, ses principes en ressortent paradoxalement confortés comme piliers de l'ordre pénal démocratique.
