Abstract

À partir de l'analyse d'un échantillon de dossiers judiciaires, l'auteur étudie les caractéristiques sociodémographiques et pénales des mineurs détenus fin 2014 à l'Établissement Pénitentiaire pour Mineurs (EPM) de Marseille, le seul EPM de France dont toutes les places sont régulièrement occupées. Il montre que, contrairement à la réputation dont pâtit la ville, ces mineurs délinquants ne sont pas poursuivis pour des infractions plus violentes qu'ailleurs. En revanche, ils présentent des fragilités sociales très importantes, qui laissent penser que leur placement en détention provisoire procède surtout du fait que les magistrats ne savent pas quoi en faire d'autre.
