Abstract
La sentencia resuelve nuevos recursos planteados por la aseguradora Mapfre en relación con la responsabilidad civil de la compañía aérea "Spanair" en el accidente de la aeronave que cubría la ruta Madrid-Las Palmas de Gran Canaria y que tuvo lugar el día 20 de agosto de 2008. Los recursos plantean la aplicación al ámbito de los accidentes aéreos sujetos al Convenio de Montreal de los intereses de demora del Art. 20 de la Ley del Contrato de Seguro. También plantea diversas cuestiones vinculadas a la aplicación orientativa del baremo a accidentes ajenos al ámbito de la circulación; en particular, la posibilidad de indemnizar a víctimas secundarias no contempladas nominalmente en el baremo, así como la cuestión relativa a la reparación íntegra del lucro cesante
