Le terme polysémique « zombi » est associé, dans la pop culture occidentale, à des situations qui ne se prêtent pas à une analyse juridique. Dans la culture haïtienne, la zombification constitue néanmoins une réalité concrète, traitée dans le Code pénal depuis 1864. En revanche, la législation civile ne fait aucune référence − directe ou indirecte − à un tel phénomène. Cette étude examine les articles du Code pénal haïtien réprimant les pratiques de zombification. Il s’intéresse aussi à la protection juridique du zombi, cette « personne ressuscitée » que le juge de paix qualifie simplement de revenant, un statut qui, pourtant, n’existe pas en droit des personnes.
