Abstract

La Cour des comptes a fait l’objet de travaux académiques de nature historique et juridique pour l’essentiel. C’est cependant sous l’angle des processus de décision et de jugement que cet article voudrait s’intéresser à cet objet institutionnel particulier, à la fois en termes de procédures liées au principe de collégialité et comme contre-pouvoir. Dans cette perspective, nous développerons l’hypothèse que son fonctionnement s’éclaire à la lumière des thèses de Proudhon sur la délibération, qui préfigurent les diverses théories sur la démocratie délibérative et les dépassent de fait en intégrant la dimension institutionnelle centrale du contre-pouvoir. Cette réflexion est ici proposée d’un point de vue à la fois théorique et pratique, informée par une double approche universitaire et administrative, liée aux points de vue et parcours respectifs des deux auteurs.
