Abstract
Sessiz istifanın iş ilişkisine yansımalarına ilişkin özellikle yönetim ve psikoloji gibi farklı bilim alanlarında çalışmalar yapılmakla birlikte hukuki boyutuna dair az sayıda çalışma bulunmaktadır. Bir işyeri tepkisi olarak gündeme gelen sessiz istifa, kural olarak işçinin bireysel davranışları sonucunda ortaya çıkmaktadır. Kısaca, işçinin iş sözleşmesindeki görevlerini asgari düzeyde yerine getirerek daha fazla sorumluluk almamasını ifade eder. Sessiz istifa, gerçek anlamıyla bir işten ayrılma veya istifa anlamına gelmemekte, iş ilişkisi devam etmektedir. İşçi, iş görme borcunu mevzuata, iş sözleşmesine ve işverenin talimatlarına uygun, normal çalışma süresi içerisinde ifa etmektedir. Yani, işin temel gereklilikleri yerine getirilmekle birlikte işçi işini asgari düzeyde olması gerektiği kadar yapmaktadır. Ayrıca işçi, işyerinde daha az sorumluluk alma, zorunlu olmadığı sürece fazla çalışma taleplerini reddetme eğilimindedir. İşçinin asgari düzeyde performans gösterdiği bu süreçte, pasif bir çalışma içerisinde olduğu söylenebilir. İşçileri sessiz istifaya yönlendiren en önemli nedenlerden birisi iş-yaşam dengesinin sağlanmasıdır. Bu dengenin sağlanabilmesi, işyerindeki düzene ve çalışma koşullarına bağlıdır. Sessiz istifa, kural olarak işçinin bireysel davranışları sonucunda ortaya çıkmaktadır. Ancak, aynı işyerinde çalışan işçilerin bu yöndeki davranışlarıyla birlikte işvereni baskı altına alma hedefine yöneldiği hallerde, kolektif nitelik kazanabilir. Bu durum, sessiz istifanın toplu eylem hakkı kapsamında değerlendirilmesini gerektirir. Ayrıca, bu kapsamda, toplu eylemin meşruluğuna ilişkin sınırlar önem taşımaktadır. Çalışmamızda, sessiz istifanın kolektif bir eyleme dönüşmesi halinde, bunun bir sessiz/pasif protesto ve bu anlamda bir toplu eylem biçimi olarak kabul edilip edilmeyeceği değerlendirilecektir.
