Abstract
Актуальність статті полягає в тому, що сучасний етап розвитку державності характеризується зростанням кількості глобальних і національних викликів, які становлять загрозу безпеці суспільства, стабільності політичних інститутів та функціонуванню правових систем.Природні катастрофи, пандемії, воєнні конфлікти, терористичні загрози та інші кризові явища зумовлюють необхідність оперативного реагування з боку держави, що нерідко потребує запровадження спеціальних правових режимів.Одним із таких механізмів є правовий режим надзвичайного стану, який передбачає тимчасове розширення повноважень органів державної влади та можливість обмеження окремих прав і свобод людини з метою забезпечення публічної безпеки та відновлення нормального функціонування суспільства.Водночас застосування такого режиму завжди пов'язане з ризиками надмірного втручання держави у сферу прав людини, що актуалізує проблему пошуку балансу між ефективністю державного управління та дотриманням демократичних стандартів.У цьому контексті особливого значення набуває вивчення досвіду держав із розвиненими правовими системами, зокрема США та Канада.Мета статті полягає у необхідності узагальнення досвіду США та Канади щодо формування та реалізації державної політики в умовах правового режиму надзвичайного стану.У статті, спираючись на аналіз зарубіжної літератури та норм чинного законодавства, узагальнено досвід США та Канади щодо формування та реалізації державної політики в умовах правового режиму надзвичайного стану.Відмічено, що ключовим у цих країнах є існування принципу недопущення зловживання надзвичайними повноваженнями, що досягається через механізми судового контролю, парламентського нагляду та конституційних гарантій.З'ясовано, що Канадська практика демонструє прагнення зберігати баланс між безпекою та правами людини навіть у кризових умовах, що особливо проявилося під час застосування закону у 2022 році за ініціативи уряду на чолі з Джастіном Трюдо.У цьому випадку надзвичайний режим було використано для реагування на блокування транспортної інфраструктури, але його дія була обмежена в часі та скасована після стабілізації ситуації, що підтвердило функціонування механізму стримувань і противаг.Ключові слова: США, Канада, формування, реалізація, державна політика, правовий режим, надзвичайний стан.The relevance of the article lies in the fact that the current stage of statehood development is characterized by an increase in the number of global and national challenges that pose a threat to the security of society, the stability of political institutions and the functioning of legal systems.Natural disasters, pandemics, military conflicts, terrorist threats and other crisis phenomena necessitate an operational response by the state, which often requires the introduction of special legal regimes.One of such mechanisms is the legal regime of a state of emergency, which provides for a temporary expansion of the powers of state authorities and the possibility of restricting certain human rights and freedoms in order to ensure public safety and restore the normal functioning of society.At the same time, the use of such a regime is always associated with the risks of excessive state intervention in the sphere of human rights, which actualizes the problem of finding a balance between the effectiveness of public administration and compliance with democratic standards.In this context, the study of the experience of states with developed legal systems, in particular the USA and Canada, is of particular importance.The purpose of the article is to summarize the experience of the United States and Canada in the formation and implementation of state policy under the legal regime of a state of emergency.The article, based on the analysis of foreign literature and the norms of current legislation, summarizes the experience of the USA and Canada in the formation and implementation of state policy under the legal regime of a state of emergency.It is noted that the key in these countries is the existence of the principle of preventing the abuse of emergency powers, which is achieved through mechanisms of judicial control, parliamentary oversight and constitutional guarantees.It was found that Canadian practice demonstrates a desire to maintain a balance between security and human rights even in crisis conditions, which was especially evident during the application of the l aw in 2022 at the initiative of the government led by Justin Trudeau.In this case, the emergency regime was used to respond to the blockage of transport infrastructure, but its effect was limited in time and canceled after the situation stabilized, which confirmed the functioning of the checks and balances mechanism.
