Abstract
Cet article se veut une intervention dans les débats de la littérature scientifique sur la place de la recherche juridique dans les universités. La discussion que nous proposons s’articule autour de la question de la qualification du droit comme discipline savante. Sur la base d’une conception sociologique plutôt qu’ontologique de la disciplinarité, nous avançons que le droit est une discipline savante non pas en vertu de sa relation à un objet d’étude ou à une méthodologie, mais plutôt par son aptitude à produire légitimement un discours savant reconnu institutionnellement. Notre argumentaire se fonde sur la distinction entre les points de vue internes et externes, autant au droit qu’aux disciplines.
