Abstract
La dualité du système juridique du Québec est souvent désignée par le “bijuridisme”. Mais au-delà de la simple évocation de la coexistence des deux systèmes au Canada, le “bijuridisme” fait également référence à l'interaction réciproque des deux systèmes juridiques l'un sur l'autre. Au Canada, les deux systèmes coexistent et ont tendance à s'interpénétrer. Cette mixité juridique qui trouve ses origines dans les Actes constitutionnels de 1791, est non seulement substantielle mais également systémique, et amène tout juriste québécois à naviguer simultanément dans les deux systèmes devenant ainsi un comparatiste. L'originalité du système juridique québécois se caractérise par la méthode de raisonnement et le rôle de la jurisprudence. Au Québec, le juge est au centre du processus juridictionnel ; en droit civil, le juge statue alors qu'en common law, il tente de convaincre par un raisonnement qui, cependant, l'amène de plus en plus à un résultat similaire de celui de son homologue de droit civil.
