Abstract
L'actualité juridique européenne et française en matière de développement durable conduit à un paradoxe. D'un côté, il ne peut être nié que le développement durable imprègne tant le droit européen que français. Illustration prise des évolutions récentes du droit français des affaires, force est de constater que le développement durable est devenu une réalité incontournable sur la scène juridique. D'un autre côté, le développement durable est source d'interrogations. Premièrement, sa place sur l'échiquier européen se révèle incertaine. Deuxièmement, cette notion s'entoure de brume lorsqu'il s'agit de la définir précisément. Malgré ces interrogations qui demeurent, le développement durable est omniprésent et contribue à faire évoluer le droit et ce, au point qu'il est bel et bien celui du développement durable.
