Abstract
Les arrets Viking et Laval de la Cour de justice des communautes europeennes ont eu a trancher la difficile question de la compatibilite d’une action collective des salaries avec l’exercice des libertes de circulation. La Cour a franchi un pas important en erigeant pour la premiere fois un droit social fondamental, le droit de mener une action collective, comme possible source de restriction aux libertes economiques. Pourtant, la methode choisie afin de proteger ce droit fondamental s’avere plus ambigue qu’il n’y parait. La quete d’une conciliation entre la liberte d’action collective et les autres libertes pourrait entrainer les juridictions sur le terrain du controle du recours a la greve et l’admission croissante de la responsabilite civile des syndicats des lors que les actions collectives portent atteinte aux libertes economiques.
