El daño moral en el sistema de responsabilidad por el transporte aéreo internacional: un enfoque moderno para nuevas necesidades

Abstract
El presente articulo esta dedicado al tema del resarcimiento por dano moral en el caso del transporte aereo de pasajeros, presentando los grandes casos jurisprudenciales que tuvieron a su cargo la explicitacion y delimitacion de los conceptos de accidente y lesion corporal, y en particular se analiza la extension de este ultimo y su relacion con la cuestion de la procedencia de indemnizacion por dano moral dentro el ambito del Sistema de Varsovia y del Convenio de Montreal de 1999. A continuacion, se comentan los decisorios que bucearon en la problematica planteada acerca del caracter de exclusividad que tales instrumentos revisten, y se expone la teoria de que la mas reciente jurisprudencia, en su afan de ejercer un rol tuitivo y protector de los derechos de usuario-pasajero, ha expandido los conceptos antes mencionados, a expensas de un retroceso en la interpretacion del sistema de responsabilidad por el transporte aereo internacional como causa de accion exclusiva para dar mas preponderancia a la anterior nocion de remedio exclusivo. A tal fin, y a modo de ejemplo, se propone el estudio en detalle de una linea jurisprudencial concreta, cual es la elaborada recientemente en la Republica Argentina.
