Abstract
The difficult and complex historical balance between the regulation of economic freedom on which the system is based and regulation guaranteeing the efficacy of social rights, is once again put to the test in the sphere of the European Union as a result of the interpretation of recent ECJ Sentences in the Viking, Laval and Ruffert cases. These decisions are included in a larger normative and case law body, thus qualifying current doctrine. This work analyses and connects the necessary safeguard of fundamental labour rights, especially those of a collective nature, as defined by the Constitutional Courts of the Member States. This compatibility, together with the compensating legislative response that is already being generated at European level to guarantee equal treatment and pay for identical work –probably by unifying the Monti Directive and the Directive on Services into a single Primary Law social clause– is its main contribution.
