La sentencia del Tribunal Constitucional de noviembre de 2012 declarando la plena constitucionalidad de la Ley 13/2005, de 1 de julio, por la que se modifica el Código Civil en materia de derecho a contraer matrimonio, ha consagrado jurídicamente el matrimonio entre personas del mismo sexo. Una sentencia que llega con siete años de retraso desde la interposición del recurso de inconstitucionalidad del que trajo causa, cuando la agria polémica que suscitó se ha diluido por el paso del tiempo, aunque persista la vigencia de sus argumentos jurídicos y sociológicos. En el presente artículo analizamos su contenido y fundamentación, para tratar de responder a los interrogantes que siguen vivos sobre el principio de igualdad que sirve de fundamento a la sentencia.
