Justiça terapêutica e Drug Treatment Courts: perspectivas de uma contextualização do sistema canadense ao brasileiro sob alguns aspectos funcionais e criminológicos

Abstract
A presente pesquisa consiste em possibilitar a ampliação da discussão acerca da implantação de forma padronizada do programa de Justiça Terapêutica no Brasil, seguindo as orientações do modelo e da experiência da Drug Treatment Court de Toronto, Canadá. Para tanto, foram realizadas diversas observações nos procedimentos adotados tanto na cidade de Toronto como em Porto Alegre, para que, a partir de alguns elementos já existentes no sistema legislativo pátrio, pudesse ser verificada a operacionalidade do oferecimento judicial de um programa de tratamento à dependência química aos acusados de terem praticado infrações associadas ao consumo de droga. As observações foram presenciais na Drug Treatment Court de Toronto, no Centre for Addiction and Mental Health e nas Varas judiciais de Porto Alegre, possibilitando visualizar diversas características e oportunidades para que seja desenvolvida a prática terapêutica. Entretanto, além da necessidade de compatibilidade entre as premissas das Drug Treatment Courts com as leis brasileiras, atenta-se para as questões de cunho criminológico que orbitam o tema. Sob esse aspecto, busca-se estudar os possíveis efeitos e consequências que a implantação do programa pode trazer para os envolvidos, possibilitando uma avaliação sobre os pontos positivos e negativos que podem ser atribuídos ao programa na hora de decidir pela incrementação, ou não, das práticas da Justiça Terapêutica no Brasil.
