Abstract
L’intégration de la fiducie dans le droit québécois est un révélateur de l’évolution de la pensée juridique québécoise. Malgré la volonté de certains auteurs de reconnaître une ascendance civiliste à l’institution, il est difficile de nier ses liens avec la tradition de common law, compte tenu du contexte dans lequel elle est apparue, au XIXe siècle. La fiducie illustre le problème qu’est susceptible de poser l’intégration, dans un système juridique donnée, d’une institution issue d’une autre tradition, soit de son acculturation. L’institution peut se fondre dans le système récepteur, le transformer substantiellement ou encore subir une forme d’hybridation. Ces modèles ont été utilisés à tour de rôle ou concurremment pour tenter de préciser le champ d’application et le régime juridique de la fiducie. Depuis des décennies, l’institution a suscité des controverses jurisprudentielles et doctrinales qui ont forcé les juristes à proposer des aménagements au droit civil afin de parvenir, non sans difficultés, à une certaine harmonisation des traditions juridiques.
