... Section 15 of the Canadian Charter of Rights and Freedoms is a powerful ally of Indigenous peoples' efforts towards achieving the goal of individual equality within Canadian society. ... Justice for Aboriginal peoples requires that Canadians not unduly restrict their understanding of equity solely to an individual equality-seeking paradigm which excludes a broader notion of equality including the right of Indigenous nations to collective equality or inter-societal equality. ... Thus, on a more limited internal government-to-government level, subject to the overriding interests of the Canadian state, Indigenous peoples may be able to achieve a limited piece-meal level of collective political equality (providing the Aboriginal collective has the stamina and resources to constantly assert through litigation specific and narrowly defined self-government powers). ... The more frequently the court is presented with persuasive arguments that embrace an interpretation of section 35 as including the inherent right to self- government, the greater is the likelihood of furthering the interests of political equality for Indigenous nations. ... This purpose can be realized through the expansion of a second track to pursue collective political equality for Indigenous nations. ... Although the current state of Aboriginal jurisprudence under section 35 is very limited in what it can offer Indigenous nations' aspirations for greater political status and recognition, it, nonetheless, is a vehicle for furthering equality along this second track. ...HIGHLIGHTS:In this article the author argues that because section 15 of the Canadian Charter of Rights and Freedoms is more attuned to the realization of individual equality rights it does not meet the aspirations of Indigenous peoples for recognition of collective equality rights. These rights are seen as being important to advance the goal of self-government for Indigenous peoples. The author then suggests that section 35 of the Constitution may be used to enhance equality rights so as to recognize collective rights of Indigenous peoples. For this to happen, one practical step would be for the Government to widen the Court Challenges Program to accommodate Aboriginal claims brought under section 35 of the Constitution.
