Beihefte zum Münsterischen Kommentar , vol. 50. Essen: Ludgerus Verlag, 2007. To honor Heinrich J. F. Reinhardt, Professor of Canon Law at the Ruhr-Universität Bochum, Diocese of Essen on his sixty-fifth birthday, the editors invited his colleagues from various disciplines to participate in this Festschrift to express their esteem for this prominent German canonist. This Festschrift is divided into two main chapters: chapter one is on canon law (26 articles) and chapter two is on the theology and history of the Church and the ecumenical movement (12 articles). Four articles are presented to demonstrate briefly the great value of this Festschrift: Rüdiger Althaus’s study addresses reforms at the parish level with a special focus on financial aspects (pp. 31–50). The current issues , mostly various forms of parish clustering, are at various stages of implementation; such a variety of concepts precludes a uniform solution to financial concerns. The author highlights effects of parish clustering before he concludes with recommendations on various questions. Franz Kalde’s article on the papal bull Germanicae gentis (February 23, 1957) deals with the erection of the diocese of Essen on January 1, 1958 (pp. 231–252). The author examines the external and internal characteristics of the bull, commenting on their content from a canonical point of view with a special focus on cause, motivation, details, and individual dispositions. Johannes Madey studies the title and canonical position of the archiepiscopus maior of the Eastern Catholic Churches (pp. 333–345). The author points out the advantage of having a well defined terminology in the CCEO. The title archiepiscopus maior is used for a pastor with supra-metropolitan power and nearly in the same position as a patriarch with the few exceptions indicated in the CCEO. Karl-Heinz Selge presents possibilities of merging tribunal and pastoral ministry when it comes to a declaration of nullity of a marriage (pp. 389–410). Ministers in tribunals do not simply fulfill their function in the jurisdictional order (Dignitas connubii, art. 308). Existing pastoral care offices, on the other hand, do not fulfill their function only in pastoral matters. Both offices intersect in various forms of collaboration to assist and guide those approaching such ministers because of a failed marriage. 496 the jurist book reviews 497 This book contains much wisdom and valuable information—canonical , theological, and historical. The authors present their articles in a scientific manner with extensive footnotes. Experienced canonists and novices will find this book a helpful source of information. Roma: Pontificia Universitas Sanctæ Crucis, Facultas Iuris Canonici, 2007. Book I of the Code of Canon Law, General Norms, is of particular importance in the administrative life of the Church. For example, more than simply administrative praxis, the canons assist in the implementation of certain suggestions approved by the 1967 synod of bishops concerning the revision of the code, such as the protection of rights and fostering the pastoral care of souls. While many canons repeat previous norms, and thus, according to canon 6 §2, must be interpreted in light also [etiam] of the canonical tradition, the use of etiam indicates that the canons must take cognizance of developments in the law and certain essential keys to interpretation, such as the conciliar doctrine on the Church (e.g., Sacrae disciplinae leges). This dissertation makes an important contribution to such an analysis of book I of the code. More specifically, as the author states in his Introduction , the text investigates “the motivation of singular administrative acts in canon law,” specifically, canons 51 of the Code of Canon Law (CIC) and canon 1519 §2 of the Code of Canons of the Eastern Churches (CCEO) with analysis of the various implications deriving from such an investigation.
