В работе анализируется текущая деятельность по правовому регулированию контроля за эмиссией метана (СН4), главного короткоживущего парникового газа, в контексте выполнения Парижского соглашения по климату 2015 г. и Глобального обязательства по метану (Global Methane Pledge, GMP) 2021 г. Основное внимание уделяется государствам Азиатско-Тихоокеанского экономического сотрудничества (АТЭС) – США, Канаде и Австралии, входящим в первые двенадцать государств, расположенных в порядке убывания их вклада в общемировые выбросы метана. Суммарные выбросы метана этими 12 странами превышают 61% глобальной эмиссии, причём США, Канада и Австралия (одни из наиболее значимых государств-эмитентов АТЭС) отвечают за ~20% суммарных выбросов СН4. Сделан вывод, что Парижское соглашение, являющееся в настоящее время базовым нормативным правовым актом, призванным ограничивать рост глобальной температуры к концу XXI века 1,5–2,0 °C по сравнению с доиндустриальным периодом, нуждается в совершенствовании законодательного сопровождения ограничения выбросов метана. GMP, в свою очередь, является важным документом, задача которого оценить необходимые объёмы сокращения эмиссии СН4 и осуществить комплекс мер по регулированию этой эмиссии для достижения одной из основных целей Парижского соглашения. Эффективная стратегия для достижения этой цели состоит в разработке и имплементации юридически обязывающих как международных, так и внутригосударственных нормативных правовых актов основных государств-эмитентов в сфере ограничения выбросов метана, в том числе в национальном законодательстве членов АТЭС – США, Канаде, Австралии. The paper analyzes the current activities on legal regulation of control over the emission of methane (CH4), the main short-lived greenhouse gas, in the context of the implementation of the Paris Climate Agreement of 2015 and the Global Methane Pledge (GMP) of 2021. The focus is on the states of the Asia-Pacific Economic Cooperation (APEC) – the United States, Canada and Australia, which are among the first twelve states, arranged in descending order of their contribution to the global methane emissions. The total methane emissions of these 12 countries exceed 61% of global emissions, with the United States, Canada, and Australia (some of the most significant APEC emitters) accounting for ~20% of total CH4 emissions. It is concluded that the Paris Agreement, which is currently the basic regulatory legal act designed to limit the growth of global temperature by the end of the 21st century to 1.5–2.0 degrees Celsius compared to the pre-industrial period, needs to improve the legislative support for limiting methane emissions. GMP, in turn, is an important document that aims to assess the necessary reduction of CH4 emissions and implement a set of measures to regulate these emissions in order to achieve one of the main goals of the Paris Agreement. An effective strategy for achieving this goal is to develop and implement legally binding international and domestic regulations by the main emitting countries to limit methane emissions, including in the national legislation of APEC members such as the United States, Canada, and Australia.
