Dans les rapports de droit privé, les tiers sont habituellement définis comme des étrangers. Ce postulat soutient la clôture des situations juridiques, refermées ainsi sur le sujet et l’objet de droit ou sur la relation exclusive entre deux sujets. \nThéoriquement cette construction s’affirme par les principes de relativité et d’opposabilité. En ce sens, les tiers formeraient globalement un magma indifférencié, tenus à l’obligation \npassive universelle de ne pas interférer sur les activités juridiques d’autrui. L’auteure soutient que, dès lors \nqu’ils sont interpellés explicitement ou implicitement par la loi, on leur reconnaît une qualité singulière qui repose sur les relations qu’ils entretiennent avec les sujets ou l’objet de \nla situation juridique visée : rapports affectifs ou patrimoniaux, rôle socialrelié à leurs compétences particulières, \npouvoirs publics délégués. Ces interpellations, non seulement \nles tirent de l’anonymat où on les confinait, mais produisent à leur endroit des effets inattendus qui transcendent les principes fondateurs de la relativité et de l’opposabilité. \nLa présence des tiers dans les situations juridiques simples, comme les droits liés à la personnalité et les droits réels, façonne un réseau complexe de liens sociaux qui défie la \nconstruction juridique fondée essentiellement sur l’individualisme.
