Abstract
Le jeu pathologique est un desordre progressif qui differe du jeu social ou professionnel en ce qu'il est caracterise par une perte de controle des impulsions. Le DSM-IV etablit les criteres d'un diagnostic de jeu pathologique: impulsivite, tendances rebelles, hyperactivite avec deficit d'attention, narcissisme, troubles d'adaptation, etc. Les relations interpersonnelles sont penibles et, par le fait meme, il est difficile d'etablir une communaute conjugale et parentale de vie et d'amour. La jurisprudence rotale n'a pas encore developpe les effets du jeu pathologique sur le consentement matrimonial. Jusqu'ici, le desordre n'est pas considere en lui-meme comme etant une cause invalidante du consentement; le comportement problematique doit s'etre manifeste avant le mariage et le sujet doit demontrer d'autres problemes psychiques serieux. Les sentences rotales sont encore basees sur l'opinion selon laquelle le desordre du jeu pathologique n'est pas incurable et qu'il ne peut donc pas en soi etre une cause de nullite. Pourtant, d'apres le DSM-IV, les dernieres recherches medicales prouvent que le desordre est excessivement difficile a soigner. Puisque le domaine est encore relativement inexplore en jurisprudence canonique.
