Abstract
Continuando en el marco de nuestro trabajo en relacion con los principios rectores del nuevo proceso penal colombiano –Ley 906 de 2004–, en esta nueva ocasion abordamos aqui un estudio en relacion con el principio-derecho-garantia de la presuncion de inocencia, a efectos de presentar, desde una perspectiva garantista, el sentido y alcance que el mismo debe tener dentro de los modelos acusatorios de enjuiciamiento. Es nuestro proposito reafirmar, dada la vigencia del principio acusatorio, que toda persona que sea sujeto pasible de un procesamiento penal, se encuentra legalmente amparada por una presuncion de inocencia que debe ser desvirtuada por el Estado; que, por tal razon, no solo tiene la obligacion de tratarlo como tal durante el curso de aquel sino tambien, el deber de demostrar su culpabilidad –sin que esta carga probatoria pueda invertirse–, con base en un convencimiento fundado mas alla de toda duda razonable y, a su vez, toda duda ha de resolverse de manera favorable al procesado (in dubio pro-reo).
