La infancia se refiere a una etapa de la vida que, historicamente, se ha visto modificada en su concepcion. El siglo XX ha sido el gran transformador de los derechos de los ninos y de las ninas. Especificamente, la Convencion de los Derechos del Nino (1989) (CDN) ha sido el instrumento juridico que ha possibilitado un mayor avance en el reconocimiento de los ninos y de las ninas como personas con derechos y responsabilidades. De esta manera, actualmente la infancia es considerada como una nueva categoria social (Qvortrup, 1992), siendo un periodo de juegos e ingenuidad. Ahora bien, como es sabido, hay muchos ninos y ninas en el mundo que todavia estan siendo considerados como mano de obra, en determinadas actividades economicas, por su inocencia y sus caracteristicas fisicas, incumpliendose asi la norma legal de la edad minima laboral establecida. Es dificil obtener datos concretos acerca del problema del trabajo infantil por su clandestinidad, aunque si son conocidas las imagenes de ninos-as en prostibulos, servicios domesticos, en basureros o tareas agricolas. Pero ademas, dicha dificultad siempre ha estado agravada por la ausencia de definiciones juridicas estables y por la dificultad para establecer indicadores de medicion. Porque, a pesar de los intentos realizados, desde el ano 1992, por el programa de informacion estadistica SIMPOC-IPEC3, aun se puede afirmar que existe una laguna en la obtencion de datos reales, derivada de la escasez de uniformidad en los mismos.
