Abstract
Les monographies intitulees Property: Meanings, Histories, Theories et Feminist Perspectives on Land Law viennent s’ajouter, en temps opportun, a la bibliographie relativement restreinte sur les theories feministes en matiere de droit des biens. Les deux volumes portent sur les liens entre les biens et l’inegalite. Property: Meanings, Histories, Theories , de la juriste feministe australienne, Margaret Davies, examine le concept de la propriete et les justifications de l’institution de la propriete privee dans le contexte de la pensee liberale occidentale. Ce court volume illustre les objectifs de la serie « Critical Approaches to Law » de Routledge qui vise a publier des oeuvres theoriques critiques, accessibles et interdisciplinaires. Le livre de Davies est une introduction, bien ecrite et bien structuree, a la theorie de la propriete traditionnelle aussi bien que critique, avec suffisamment de profondeur pour presenter une lecture d’interet meme pour les personnes deja au courant de la theorie de la propriete. Le volume Feminist Perspectives on Land Law , dont les deux co-redactrices Hilary Lim et Anne Bottomley, sont des juristes universitaires feministes de la Grande-Bretagne, regroupe une collection non structuree de douze essais. Huit de ces essais portent uniquement sur les lois britanniques concernant les biens fonciers. Meme si la collection peut d’abord sembler un peu limitee du point de vue d’un lectorat canadien, elle presente neanmoins un interet plus vaste car il s’agit d’une tentative d’elaborer une theorie a partir de la base, c’est-a-dire en se fondant sur les conditions materielles qui influent sur l’acces des femmes a la propriete. Abstract: Property: Meanings, Histories, Theories and Feminist Perspectives on Land Law are welcome additions to the relatively small body of feminist theorizing about property law. Both focus on the connections between property and inequality. Property: Meanings, Histories, Theories , written by the Australian legal feminist, Margaret Davies, looks at the concept of property and the justifications of the institution of private property in the context of Western liberal thought. This short book exemplifies the goal of Routledge’s Critical Approaches to Law series to produce accessible, critical, inter-disciplinary, and theoretical work. Davies’s book is a well-written, well-structured introduction to both traditional and critical property theory, with enough depth to be a worthwhile read for those already familiar with property theory. Feminist Perspectives on Land Law , edited by two British feminist legal scholars, Hilary Lim and Anne Bottomley, is an unstructured collection of twelve essays. Eight of those essays concentrate on uniquely British statutes affecting real property. Although it might initially strike a Canadian reader as rather parochial, the collection has broad appeal because it is an effort to build theory from the ground up—that is, based upon the material conditions that affect women’s access to land.
