Abstract
L’extension des prérogatives des victimes au procès pénal suscite depuis de nombreuses années de vifs débats, aussi bien en France qu’aux États-Unis. À partir de l’examen du travail doctrinal entrepris par les juristes dans ces deux pays, depuis les années 1980, l’article met en évidence le « répertoire normatif » avec lequel ceux-ci envisagent la place des victimes au procès. Ce répertoire est structuré autour d’une série d’attentes concernant tant le déroulement du procès pénal (l’objectivité du jugement, l’équité du procès, le juste dosage des souffrances) que ses finalités. L’article montre comment le débat autour des victimes contribue à retravailler ces attentes et comment se dessinent, sur la base de ce répertoire commun, les lignes de fracture et de rapprochement entre juristes. Il esquisse de nouvelles perspectives sur la façon dont ce travail doctrinal s’articule avec des politiques pénales marquées traditionnellement par l’opposition entre des positions répressives et libérales.
