Tout canoniste sait fort bien que les criteres entourant la reorganisation d'une loi sont quelquefois a y perdre son latin! En effet, le Code de 1917 avait servi, entre autres, a faire une compilation des multiples lois en vigueur; de plus, le c. 22 prevoyait des dispositions pour l'abrogation de lois afin d'eviter que le corpus ne devienne ingerable. L'A. s'attarde ici a expliquer ce qu'est precisement la reorganisation integrale (entiere) de la loi dont on parle au c. 20 afin de determiner le ius vigens par rapport aux documents juridiques post-conciliaires et aux autres documents publies depuis. Il est quelquefois difficile de definir si une nouvelle loi reorganise partiellement ou completement une ancienne loi et, ainsi, l'A. propose huit principes d'application. Des distinctions sont faites entre « l'abrogation » d'une loi et la « derogation » a une loi, et entre une loi « directement contraire » ou « integralement reorganisee ». Elle donne un apercu de la hierarchie des divers documents juridiques, ainsi que l'effet qu'ils peuvent avoir sur des normes parentes. La reorganisation integrale d'une loi ne peut etre presumee; elle doit etre prouvee. Le contexte, le ton de la loi et la mens legislatoris doivent etre pris en consideration pour determiner si, de fait, une nouvelle loi reorganise integralement l'ancienne; de plus, une loi qui reorganise integralement est completement independante de l'ancienne loi. Finalement, si le legislateur procedait plutot par reorganisation integrale que par revocation expresse d'un document juridique, l'A. s'interroge a savoir si l'effet en serait positif ou negatif.
