Het nieuwe commentaar op art. 1 OESO-modelverdrag is gewijd aan de verdragstoepassing op collectieve beleggingsinstellingen, vooral omdat onduidelijk is of zij vanwege hun bijzondere regimes als inwoner kunnen worden aangemerkt. Verdragsluitende staten worden daarin opgeroepen om de positie van beleggingsinstellingen uitdrukkelijk te regelen. In de Notitie Fiscaal Verdragsbeleid 2011 is aan deze oproep gehoor gegeven. De door Nederland met het Verenigd Koninkrijk en Canada gesloten "Competent Authority Agreements" bevatten ten behoeve van in Nederland gevestigde besloten fondsen voor gemene rekening een concrete uitwerking van dit beleid. Zij regelen de toekenning van verdragsvoordelen aan in Nederlandse gevestigde besloten FGR's die in deze staten beleggen. In deze bijdrage onderzoekt de auteur hoe Nederland in genoemde Agreements uitvoering heeft gegeven aan de in het commentaar van het OESO-modelverdrag opgenomen suggesties.
