Abstract
Los altos indices de morosidad existentes, derivados del actual contexto de crisis economica, estan provocando unos importantes costes economicos para las empresas y demas proveedores de bienes y servicios, debido a que estos, con caracter general, estan obligados a repercutir el IVA a sus clientes en factura por las operaciones gravadas que realicen y a ingresar el impuesto a la Hacienda Publica, pese a que dichas facturas puedan resultar impagadas a su vencimiento. Con el fin de mitigar estos costes, la normativa del IVA permite a los proveedores de bienes y servicios, en dos casos muy concretos, recuperar de la Hacienda Publica el IVA que repercutieron en factura a sus clientes por las operaciones gravadas realizadas y que, sin embargo, no fue abonado por estos ultimos como consecuencia del impago de las facturas. Estos dos casos son, bien cuando el cliente haya sido declarado en concurso de acreedores, o bien cuando la cuota del IVA adeudada por este es considerada credito incobrable, de acuerdo con lo establecido en la normativa del impuesto. Es, por tanto, cuando se produce alguna de estas dos circunstancias cuando el proveedor de los bienes o servicios puede recuperar de la Hacienda Publica la cuota del IVA ingresada previamente que ha resultado impagada, si bien para ello es necesario el estricto cumplimiento de una serie de requisitos objetivos, subjetivos, temporales y formales establecidos tanto en la Ley como en el Reglamento del IVA. La falta de los recursos necesarios para cumplir con los requisitos establecidos a tal efecto puede llevar a las empresas y demas proveedores de bienes y servicios a no gestionar eficientemente esta importante oportunidad de ahorro de costes.
