Abstract
RésuméTout code nouveau se veut rupture avec le droit antérieur. En ce sens, la codification d’une nouvelle institution pénale en fait presque toujours un choix majeur de politique criminelle. Ce processus de systématisation amène donc à s’interroger de manière continue sur le devenir de telle ou telle institution qui trouve son fondement juridique dans différentes lois pénales spéciales. Tel est le cas, en droit camerounais, du régime de la responsabilité pénale des personnes morales, que le législateur, à travers le projet de refonte du Code pénal en vigueur depuis plus de cinquante ans, cherche à définir aujourd’hui comme un principe général.
