Abstract
Le traducteur juridique algérien est confronté à de réelles difficultés lors du transfert de l’arabe vers le français de certains termes juridiques arabes tirés du droit musulman. En effet, en plus de l’obstacle linguistique tenant au passage de l’arabe au français, il est confronté à la difficulté que représente le transfert culturel d’un système juridique étroitement lié à la religion musulmane, à un autre système d’une toute autre tradition juridique. Il se trouve donc fortement tiraillé entre sa recherche de l’équivalence linguistique et sa quête de fidélité envers la portée juridique du texte de départ. La difficulté est accentuée par la nature de la terminologie juridique islamique, fortement marquée culturellement.
