Abstract
L’exigence d’un consentement libre et éclairé du participant représentait, pour les auteurs du Code de Nuremberg (1947), la pierre angulaire de l’éthique de la recherche sur des humains. Amorcée par la déclaration de Helsinki, en 1964, la désaffection à l’égard du consentement s’est poursuivie ultérieurement sur le continent nord-américain, particulièrement au moment de l’élaboration des normes éthiques, d’abord aux États-Unis, puis au Canada et au Québec.Récemment, le rapport d’un comité interministériel préparé en vue de l’élaboration d’un cadre législatif de la recherche au Québec a été rendu public. Ses recommandations relatives au consentement ainsi qu’au rôle des comités d’éthique de la recherche, si elles sont adoptées par le législateur, sont susceptibles d’accentuer l’effritement du principe de l’autonomie des sujets de recherche et de son corollaire, l’exigence du consentement.Cet article, après un rappel des moments clés de l’histoire du consentement en recherche sur des humains, propose une évaluation critique des recommandations du rapport.
