Cet article rend compte d’une partie d’un travail de recherche portant sur l’étude de la pénalité en tant que pratique discursive dans la formation de deux événements concomitants : un meurtre et une pendaison. L’oeuvre d’une main criminelle et l’oeuvre de la justice. Il s’agit d’une pendaison au Québec en 1930. Le matériel d’analyse est composé de tous les documents d’archives se rapportant à l’événement. La méthode archéo-généalogique de Michel Foucault a été utilisée de façon exploratoire comme approche pour l’interprétation analytique. Les auteurs analysent certaines pratiques qui ont servi à constituer la signification des deux énoncés. Pour la constitution du meurtre, les auteures considèrent l’aveu et l’enquête du coroner sur le corps de la victime et, pour la constitution de la pendaison, elles traitent du travail de la gestion du corps du condamné, du travail de gestion de la journée de la pendaison. Elles rendent aussi compte de quelques mouvements de résistance. L’analyse montre, entre autres, la forme ritualisée du processus judiciaire et le processus de dégradation statutaire et de gradation statutaire en lumière des diverses stratégies et tactiques employées.
