Pour traduire la common law, il faut que le traducteur prenne en compte sa caractéristique la plus marquante, la casuistique. Celle-ci constitue un trait essentiel du système juridique anglo-saxon. Par conséquent, le traducteur doit respecter l’intention communicative qui lui est sous-jacente, c’est-à-dire la distinction de cas ayant des finalités différentes. Dans le présent article, nous étudions la casuistique anglo-saxonne en la comparant à la tendance généraliste du droit civil et aux principes généraux comme source du droit dans les systèmes juridiques. Nous distinguons également deux types de casuistique : la casuistique utilisée à titre d’illustration ou d’exemple et la casuistique liée à une intention d’exhaustivité.
