Par deux arrêts en date du 18 décembre 2014 et du 30 janvier 2015 les Conseils d’États belge et français ont prononcé l’annulation, totale ou partielle, des circulaires relatives aux dispositifs de mise à l’abri, d’évaluation et d’orientation des mineurs isolés étrangers. Le juge de l’excès de pouvoir a ainsi porté un coup d’arrêt manifeste à des dispositifs contestés depuis leurs entrées en vigueur par les défenseurs des droits de l’enfant. Néanmoins, l’observation des motivations juridictionnelles laisse percevoir l’évanescence de l’intérêt supérieur de l’enfant au profit d’une approche formelle sanctionnant les négligences de l’administration. Dès à présent, il importe donc d’apprécier le sens et la portée des arrêts rendus par le juge administratif afin de saisir pleinement, en dépit de l’annulation, les enjeux d’une mobilisation continue dans la lutte pour l’effectivité des droits des mineurs isolés étrangers.
