La Loi sur l’assurance automobile représente l’exemple parfait de la loi remédiatrice qui doit recevoir une interprétation large et libérale pour assurer l’accomplissement de son objet. Depuis les débuts du régime d’indemnisation sans égard à la responsabilité, en 1978, la Cour d’appel du Québec a constamment appliqué cette règle d’interprétation afin de garantir une compensation équitable au plus grand nombre de victimes. Une décision rendue à la fin de 2010 s’écarte toutefois de cette ligne de jurisprudence et constitue une menace pour la pérennité du régime. L’analyse de l’arrêt Rossy c. Ville de Westmount sera l’occasion de revenir sur la jurisprudence antérieure et d’aborder d’autres hypothèses litigieuses, notamment le cas du suicide commis à l’aide d’une automobile et celui du surf sur véhicule (car-surfing), où les tribunaux inférieurs peinent à dégager des solutions respectueuses des droits des victimes et des objectifs poursuivis par le législateur.
