De la négociation conflictuelle à la négociation concertative : un « Point de Passage Transactionnel »

Résumé Selon Christophe Dupont (2006), certains processus de négociation sont à dominante conflictuelle alors que d’autres sont à dominante concertative, en vertu d’une intention différente. Mais comment passer, au cours d’un même processus, d’une négociation conflictuelle à une négociation concertative ? Nous avons exploré le passage de l’une à l’autre grâce à l’analyse comparative de processus de négociation pour le partage de ressources naturelles ou la gestion de biens d’environnement soumis à des usages concurrents. Sur la base de trois exemples, en France, au Guatemala et au Canada, nous nous attachons à mettre en évidence l’existence de mécanismes similaires dans des contextes très différents : un préaccord apparaît comme un point de passage obligé qui permet de passer d’une situation d’affrontement à une situation de coopération en vue d’une construction commune. Chacun l’accepte car ce préaccord engage la partie adverse. L’analyse de la construction de ce préaccord et de son contenu nous conduit à le qualifier de point de passage transactionnel : il définit un univers de coopération et tend à irréversibiliser l’engagement de chacune des parties dans le processus, ainsi que son changement d’intention. Une lecture théorique de ces mécanismes est proposée, en mobilisant la sociologie de l’innovation : en résultent certaines déductions opérationnelles.
