Abstract
Résumé Malgré son existence depuis plus de deux décennies, le concept d’«accommodement raisonnable» défraie la chronique quotidiennement. Cela se répercute dans tous les milieux. Ainsi, rares sont les employeurs qui n’ont jamais fait face à une demande particulière de la part d’un salarié en raison, par exemple, de sa religion ou de son handicap. Il est donc essentiel pour les gestionnaires d’aujourd’hui d’être en mesure de reconnaître les situations donnant lieu à un accommodement et, par la suite, de savoir les gérer en respectant des balises fixées par la loi et appliquées par les tribunaux. L’article examine les fondements de l’obligation d’accommoder, les raisons d’accommoder, le test élaboré par la Cour suprême du Canada, la limite du devoir d’accommodement, soit la contrainte excessive. Puis il se penche sur la preuve que doit produire l’employeur et sur la responsabilité qui incombe au salarié accommodé. Enfin, trois cas pratiques illustrent les différents principes avancés.
