L’auteure évalue, sous le prisme du droit québécois, les problèmes liés à la reconnaissance des faits et à la preuve qui se posent en matière de harcèlement moral dans le droit français, malgré l’introduction de dispositions particulières dans le Code du travail par l’adoption de la Loi de modernisation sociale en 2002. La législation, tant française que québécoise, exige que le harcèlement moral produise des effets sur la victime. Plus précisément, le législateur français impose une atteinte portant soit sur la santé du salarié, sur sa dignité ou ses droits ou encore sur la compromission de son avenir professionnel. Les conséquences du harcèlement doivent aussi se faire sentir sur le milieu de travail du salarié. Quant aux comportements en cause, ils doivent présenter un caractère répété sans toutefois nécessiter d’abus de pouvoir entre le harceleur et le harcelé. Comme le harcèlement demeure une affaire de perception, il demeure difficile à démontrer. En fait, les seuls témoins sont souvent le harceleur et sa victime. Même s’il existe d’autres témoins, ceux-ci n’osent pas parler. Le législateur français a donc prévu une présomption de harcèlement et une protection pour les témoins afin de faciliter la preuve du salarié. Ces dispositions n’ont pas d’équivalent en droit québécois, mais semblent néanmoins insuffisantes, en raison de l’interprétation qu’en font les juges français.
