Nouvelles normativités de la famille : la garde partagée au Québec, en France et en Belgique

Abstract
Cet article porte sur les réformes récentes effectuées en France, en Belgique et au Québec en matière de résidence alternée, d'hébergement égalitaire et de garde physique partagée. Quelles en sont les configurations ? Comment expliquer qu'elles tendent vers le même modèle de reconstruction de l'institution familiale ? Quels sont les impacts des réformes mises en place et quelles normativités sous-tendent-elles ? Une étude de cas multi-site a été réalisée en faisant appel à des sources primaires et secondaires diverses : analyse des nouvelles dispositions législatives et administratives, analyse des études sur la question parues dans les trois juridictions civilistes, entrevues qualitatives auprès de parents, de médiateurs et de juristes québécois. Dans les trois juridictions étudiées, l'idéal de l'égalité et de l'individuation au sein de la cellule familiale hétérosexuelle a été matérialisé en termes de garde physique partagée et celle-ci, à son tour, a été transposée en termes de droit, précédant ainsi les changements sociaux et familiaux. Il s'agit ici de la première étude comparative de cet ordre ayant pour objet les transformations sociales liées à la garde partagée.
