Abstract
Les petits mammifères marins sont très présent, mais également très menacés en mer du Nord. Afin de protéger ces animaux, sept Etats (Allemagne, Belgique, Danemark, Pays-Bas, Pologne, Royaume-Uni et Suède) ont ratifié en 1994 un Accord sur la Conservation des petits cétacés dans la mer Baltique et la mer du Nord (ASCOBANS). Cet Accord, affilié à la Convention sur la conservation des espèces migratrices appartenant à la faune sauvage (CMS), consiste en un plan de gestion destiné entre autres à conserver les habitats, initier des études sur le sujet et informer, en particulier les pêcheurs. Des organes ont été créé afin de présider au bon fonctionnement de l’Accord. Cette bonne volonté affichée se heurte néanmoins aux réalités, dont la plus criante est sans conteste celle des captures accidentelles, au dessus des limites acceptables. L’Accord est en outre limité dans son action par l’exclusivité de la compétence communautaire en matière de pêche dans l’ensemble de sa zone d’application. En définitive, le bilan de fonctionnement de cet Accord est très décevant, puisqu’il n’a eu aucune action concrète sur la protection des cétacés et que sa sphère d’influence apparaît très réduite.
