Abstract
La loi de separation des Eglises et de l’Etat, et plus generalement le principe qu’elle est censee concretiser, a savoir la laicite, n’ont recu qu’une application tres limitee en Algerie durant la periode coloniale. Ce principe a ete mis au service de la domination coloniale a travers les derogations successives auxquelles il a donne lieu. L’administration coloniale ainsi que le ministere de l’Interieur charge des cultes entretinrent une fiction de l’isonomie en matiere cultuelle dans l’objectif de maintenir un controle politique en direction du culte musulman tout en respectant formellement l’objectif de la mission civilisatrice. Inversement ce principe de separation des Eglises et de l’Etat s’est transforme en ressource politique de contestation de l’ordre colonial aupres de nombreux milieux indigenes d’obedience reformiste. Une politisation de cette question s’est construite grâce au travail religieux et politique de l’association des oulemas d’Algerie pour en faire une thematique majeure de la mouvance nationaliste. Aussi est-il possible de lire les mecanismes de la domination coloniale et de ses contestations a travers le prisme des positions de l’administration coloniale, des autorites metropolitaines chargees des cultes ainsi que des mouvements religieux a propos de la question de la separation des Eglises et de l’Etat.
