O CÓDIGO DE DEFESA DO CONSUMIDOR E A RESPONSABILIDADE CIVIL DA EMPRESA AÉREA

Abstract
O presente artigo tem por proposito expor brevemente o instituto da responsabilidade civil da empresa aerea sob a egide do Codigo de Defesa do Consumidor, tendo em vista que a aviacao civil, no decorrer das ultimas decadas, tem evoluido significativamente e, principalmente no Brasil, com perspectiva futura fabulosa . Em funcao disso, possibilitou-se um aumento na oferta de servico o que, por consequencia, resultou no crescimento da demanda por esta especie de transporte, seja de pessoas ou mercadorias. O consumidor, ao contratar com a empresa aerea ou transportador aereo o servico ofertado, cria com este um vinculo contratual que, ao ser inadimplido, gera o dever de indenizar. Diante disso, revelar-se-a que a responsabilidade civil do transportador aereo domestico e internacional e regulado por leis especiais como o Codigo Brasileiro de Aeronautica e pela Convencao de Montreal (substitutiva da Convencao de Varsovia), respectivamente, sem olvidar que o Codigo Civil de 2002 tambem pode ser aplicado, tanto quanto o Codigo de Defesa do Consumidor, quando necessario, a depender de tratar-se de relacao de consumo ou nao.
