On fait généralement référence au système leyde de gestion agropastorale dans le Delta du Niger au Mali comme à un modèle de gestion de la propriété indigène commune. Cet article examine l’évolution historique de l’ensemble des institutions liées au système leyδe. Cet historique révèle que ce système n’a jamais vraiment été codifié explicitement comme l’avaient suggéré des analystes indépendants. Au lieu de cela, pour offrir une gestion efficace et des lois à l’accès qui étaient loin d’être fixées mais, au contraire, variaient selon l’environnement et la politique, le système dépendait des barrières physiques et des systèmes politiques existants. Ce serait donc une erreur de considérer ces institutions comme séparées en quelque sorte de la politique, puisqu’elles ont été inspirées dès le début par la politique. Cette révision historique procure une fondation solide à partir de laquelle il devient possible d’étudier plus en profondeur les facteurs qui contribuent aux conflits actuels ayant aujourd’hui pour objet la plaine inondable — en particulier les conflits entre fermiers et bergers. L’article prend pour étude de cas un clan de bergers de la Maasina, sous-région du Delta du Niger, pour explorer les rôles de la mémoire, de l’idéologie et l’ensemble plus large des sphères politiques qui créent les circonstances propices à de sérieux conflits fonciers entre fermiers et bergers.
