Abstract

Le bilinguisme législatif a entraîné, au Canada, une forte présence de la traduction. Le texte de loi est souvent polysémique et hermétique, comportant dès lors son lot d’embûches pour le traducteur. Afin de pallier toute difficulté d’interprétation, la communauté juridique s’est dotée d’un principe fondamental, la règle d’égale autorité. Selon cette règle, les deux versions d’une loi ont le même statut, la même valeur. Or plusieurs juristes ont formulé de nombreuses critiques à l’endroit de la traduction. Ce qui a entraîné l’avènement de la corédaction des lois fédérales, qui a eu pour résultat d’évincer la traduction du processus législatif. L’objet du présent article sera, d’une part, de mettre au jour ces critiques et, d’autre part, de montrer la contradiction présente au sein de la communauté juridique.
