La crise écologique majeure que l’ensemble des sociétés traverse a fait prendre conscience que l’environnement est un bien commun qui fait l’objet d’usages parfois incompatibles. Les entreprises au cours de leurs actes de production sont à l’origine d’effets externes technologiques négatifs en dégradant certaines ressources communes. En France, une réglementation administrative a été mise en place depuis de nombreuses décennies pour encadrer les activités des entreprises réputées dangereuses pour l’environnement : le régime des installations classées pour la protection de l’environnement (ICPE). Nous avons analysé le contentieux administratif des ICPE de trois tribunaux administratifs français. L’analyse des réseaux d’acteurs montre que le droit d’agir en contestant des décisions publiques devant un tribunal administratif est un processus nécessaire pour révéler des intérêts locaux. Cette recherche permet d’éclairer la position des acteurs nombreux en dégageant des structures relationnelles dominantes autour du contentieux. Nous montrons que les recours des parties prenantes devant les juridictions administratives permettent d’ajuster les différents intérêts, car la mise en œuvre des droits d’usage de l’environnement nécessite des adaptations aux contextes locaux que le processus d’enquête publique proposé par l’État ne suffit pas à assurer.
