L’objectif de cet article est de comparer les politiques de contrainte et de soutien à l’aide de l’entourage mises en place en France et au Québec. Ces politiques comportent trois types de dispositifs : les obligations légales, les mesures financières et fiscales, la régulation de l’offre en services spécifiques et non spécifiques. Concernant les obligations légales, le dispositif français s’avère beaucoup plus contraignant que le dispositif québécois par la combinaison de l’obligation alimentaire et des contraintes sur la transmission de l’héritage (notion d’héritiers réservataires, fiscalité différentielle, récupération sur succession). Quant aux mesures financières et fiscales, les deux pays ont développé des avantages fiscaux centrés sur des déductions concernant l’impôt sur le revenu (1/2 des foyers français, 2/3 des foyers québécois potentiellement touchés par ces avantages). Une rémunération des aidants est possible en France dans le cadre de l’Allocation personnalisée d’autonomie. Elle demeure en discussion au Québec vis-à-vis de l’Allocation directe. Concernant les services, les déséquilibres offre/demande sont tels dans les deux pays qu’une forme de rationnement existe (plus marquée au Québec), tant vis-à-vis de l’hébergement que vis-à-vis du soutien au domicile.
