Cet article interroge la distinction réalité/fiction qui caractérise les discours normatifs portant sur l’État de droit. La qualité de ce dernier est régulièrement mise à l’épreuve dans l’espace public par le biais de ses institutions coercitives. Il se présente alors à la fois comme un état de fait avéré et un modèle bafoué. Cette tension est ici envisagée comme une propriété inhérente à l’État de droit plutôt qu’une alternative exclusive. L’article étudie donc les dispositifs mis en place pour réduire cette tension, dans le cas la police et de la prison. En explorant les carences du contrôle externe des prisons françaises, puis le travail d’un service de contrôle interne de la police nationale, est pointée l’aporie des diagnostics définitifs attestant de la réalité ou, à l’inverse, de la fiction de l’État de droit. Sa qualité dépend d’une série de gradations que ces dispositifs explicitent davantage que la figure de l’État en tant que tel.
